Heydon on Contract: Particular Contracts is the second of a two-volume treatise on the law of contract in Australia – No book of this precise kind has ever been published beforeThe goal of this book is to provide a compact and clear account of the basic principles underlying the fields discussed. It will be of particular interest to judges, barristers, solicitors, government lawyers, inhouse lawyers, academic lawyers, law students and interested non-lawyers.
The relationship of this volume to its predecessor (Heydon on Contract: The General Part, 2019) is partly complementary. But it is also partly supplementary, being illustrative of general contractual principles.
The particular contracts discussed are as follows:
First, contracts for the domestic sale of goods, contracts for the international sale of goods caught by the United Nations Convention on Contracts for the International Sale of Goods and contracts for the international sale of goods not caught by that Convention.
Secondly, those contracts restraining or preventing free trade which are regulated by the Competition and Consumer Act 2010 (Cth).
Thirdly, contracts throwing up particular problems in relation to s 18 of the Australian Consumer Law.
Fourthly, contracts of guarantee.
Finally, contracts of insurance.
Foreword by the Hon Michael Kirby, AC, CMG.
Speaking of the second volume, the Hon Michael Kirby referred to its "erudite analysis", its "daunting specificity" and its "mastery of the detail". He described the two volumes taken together as an "encyclopedic", "a brilliant ... exercise in taxonomy", "a masterly analysis" and a "magnum opus". And he concluded by calling the second volume an "important work of legal exposition" and "an intellectual masterpiece".
