High-profile legal cases involving individuals with mental health challenges often address complex issues that confront previous decisions of the courts, influence or change existing social policies, and ultimately have a profound impact on the daily practice of mental health professionals and the lives of their patients. Providing in-depth context into milestone cases in forensic mental health, this book addresses issues such as the confidentiality of mental health records, criminal responsibility, fitness to stand trial, the right of individuals to refuse mental health treatment, and the duty of mental health practitioners to warn and protect individuals who may be at risk of harm at the hands of a patient. The authors explore the social and political context in which these cases occurred, incorporating court decisions, contemporaneous media articles, and legal reviews in the analysis.

Graham Glancy and Cheryl Regehr, who are experts in the field of forensic psychiatry, draw upon their own practice, in addition to scholarly literature, to describe the impact of the decisions rendered by the courts in the area of mental health and offer practical guidelines for professionals working at the interface of law and mental health.

Reviews for Canadian Landmark Cases in Forensic Mental Health

A true success - Glancy and Regehr have done a splendid job of outlining landmark cases for all forensic mental health practitioners in their comprehensive book, Canadian Landmark Cases in Forensic Mental Health. In usual form, they have brought concise and clear writing accessible for lay to advanced audiences. They start with an orientation to the Canadian legal system and role of the courts. They then review many of the cases in the major practice domains relevant to current forensic practice. All sections are through the lens of an experienced forensic psychiatrist, making the information highly clinically relevant. This will undoubtedly become required reading and a resource for anyone practicing forensic mental health in Canada. - Brad Booth, Department of Psychiatry, University of Ottawa, President of the Canadian Academy of Psychiatry and the Law The legal and clinical worlds are very different in how they are organized and practiced. For the neophyte or experienced forensic mental health practitioner, these differences will seem much less perplexing given this expert guidance from Glancy and Regehr. Clearly written and very accessible, this volume addresses key Canadian cases as both landmarks on an issue and as exemplars of how the legal system operates. This work will prove of huge value to clinicians who are practicing in the forensic area. - Alexander Simpson, Chief of Forensic Psychiatry, CAMH, Associate Professor and Head of the Forensic Psychiatry Division, Department of Psychiatry, University of Toronto This is a thorough, thoughtful, and important review of case law for those of us in the mental health field. It is certain to become required reading for residents and practicing forensic psychiatrists. - Joel Watts, Department of Psychiatry, University of Ottawa, Past President, Canadian Academy of Psychiatry and the Law, Vice-Chair, Forensic Psychiatry Specialty Committee, Royal College of Physicians and Surgeons of Canada
